SANTA MARIA, Calif. - With a single ruling from a judge, Michael Jackson's child molestation trial was transformed from a courtroom drama centered on one child to a retrospective of all the accusations leveled against Jackson over more than a decade.
Now there are five additional boys who have grown to be men in the years since they visited Jackson's idyllic Neverland ranch.
Now there are intimations from the prosecutor that Jackson is not just a molester of one child but a serial molester who preys on the young.
Now there is a movie star involved — Macaulay Culkin — and two boys who took multi-million-dollar payoffs from Jackson to go away.
"This is a turning point in the case," Loyola University Law School Professor Laurie Levenson said Monday. "It's a different trial. It's no longer about one kid. It's about Jackson's character."
She said the stakes are higher after the ruling, which allows jurors to hear evidence about five past allegations that the singer molested or prepared children for molestation.
"This is going to be a dogfight," Levenson said. Defense attorney Tom Mesereau "is a very good lawyer, but you may need a magician."
The prosecution will rely primarily on third party witnesses because all but one of the previous accusers is refusing to testify.
There is also a chance that some who are named ultimately will come forward for the defense to say nothing happened. "There's Macaulay Culkin who has repeatedly said he was never molested," Mesereau said during arguments on Monday.
Culkin's publicist, Michelle Bega, said Monday that the "Home Alone" star "is presently not involved with the proceedings and we do not expect that to change."
Los Angeles defense attorney Steve Cron, who defended comedian Paula Poundstone when she pleaded no contest to child endangerment, said the ruling will extend the trial into a succession of mini-trials.
"The defense is going to attack every one of these cases, saying that everyone was getting the message that you can get money from Michael Jackson if you make these allegations, and they were all standing in line with their hands out," Cron said.
Jurors who have heard explicit descriptions of masturbation involving the current accuser, now will be confronted with more shadowy areas of what constitutes molestation.
"Some of it is kissing, hugging," District Attorney Tom Sneddon said. And some of it, he added, is inserting Jackson's hands in the underpants of boys.
The third-party witnesses are expected to say they saw things happen. Among them are people who sold their stories to tabloids for huge fees and a group of former Jackson employees who once sued the star for harassment and wrongful termination and lost. They were ordered to pay Jackson for court costs.
The defense will attack their credibility and say they are conspiring to bring down Jackson with false testimony. "The prosecution will argue where there's smoke there's fire," said Levenson. "And the defense will argue there was just a really good smoke-making machine."
